1. What does Jane offer?

Jane NV (Hereafter 'Jane') offers a digital home solution that enables you to be there for your seniors when they need you most.

For this Jane uses an application and a kit (consisting of a hub, 3 emergency buttons and up to 6 sensors) with which personal data are processed. Jane is committed to users by prioritizing respect for their privacy and the protection of their personal data. After all, customer satisfaction is central to Jane.

This policy is therefore intended to provide a transparent picture of the way in which Jane processes the personal data of its users. For example, Jane always processes personal data in line with the requirements of the new European privacy legislation: the General Data Protection Regulation (AVG or GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

Jane therefore invites users to read this information carefully. In this we make clear which personal data is processed by Jane and for what purpose. As well as what your rights are and how you can exercise them.

2. Who is responsible for the processing?

The person responsible for the processing of personal data is the public limited company Jane, with registered office at 1210 Brussels, Karel Rogierplein 11, VAT BE0699.693.959.

This means that Jane determines the purposes and means of processing this data. Jane is also the point of contact for questions about the processing.

3. Data Protection Officer (DPO)

Jane has appointed a Data Protection Officer or Data Security Officer.

4. What are personal data?

Personal data includes any information about an identified or identifiable natural person, such as a name, an identification number, location data, online identification data or any other data related to a natural person.

5. Who can Jane provide personal data to?

Personal data may be shared with external processors, such as public entities, IT service providers or marketing and communication agencies, among others. These processors can only process the personal data for the performance of the tasks assigned to them. We have concluded a processor agreement with these parties to ensure that your personal data is also processed by them in a safe and confidential manner. The processor agreement guarantees appropriate technological and organizational protective measures. Your personal data is therefore in good hands with them. 

Personal data may also be shared with recipients who are themselves controllers such as lawyers in the event of a legal discussion.

If Jane uses a processor outside the European Economic Area in this regard, at least the same level of protection will be offered as in Belgium and cooperation will only take place with a party if this party meets the conditions for international data protection as defined in the GDPR. .

6. Who at Jane has access to your personal data?

At Jane, only authorized staff members and persons designated by Jane have access to your personal data. These are only the persons who require access for the correct performance of their function or for the needs of the service.

7. Transfer to third countries

Your personal data will not be passed on by us or our processors to partners or recipients in countries outside the EEA unless there is a legal obligation to do so.

If your personal data is nevertheless passed on by us or our processors to partners or recipients in countries outside the EEA (which are not on the explicit list of EU approved countries), we will ensure that appropriate safeguards are offered with regard to protection of personal data as prescribed by the GDPR (BCR, standard contractual clauses, ...).

8. How are personal data secured?

Jane takes measures to protect the confidentiality, integrity and availability of your personal data with due diligence. We take the necessary technological and process-based measures for this and have our systems tested regularly.

 

9. What about any changes?

Jane reserves the right to change its privacy policy at any time. You can always consult the most recent versions on the website www.meetjane.be.

Your rights

The right to information
This document, together with the Cookie Policy, informs you about the processing operations Jane carries out with your personal data.

Right of access

A user has the right to inspect his / her personal data processed by Jane and to obtain additional information regarding this processing.

Right to correction

If certain data is incorrect or incomplete according to the user, he / she can ask to correct or supplement it.

Right to erasure 

If you no longer want Jane to process your personal data, you can request the DPO (privacy@jane.be) to delete this data from Jane's files / databases.

However, this right is not an absolute right and you should take into account that other legislation may limit this right. Eg. You cannot request the deletion of data for which a legal retention period has been established and this retention period has not yet been reached. 

However, you can have all personal data that we process about you on the basis of 'consent' deleted immediately when you withdraw your consent. This can be done on simple request. (privacy@jane.be)

However, Jane has a 'Compelling Justifiable Ground' for not removing any data when disputes are pending eg a lawsuit or other discussion that may have legal consequences. We cannot delete any data while such activities are in progress.

Right to withdraw consent 

When Jane processes personal data on the basis of consent, the user can have this consent withdrawn at any time and without giving any reason.

Right to restriction of processing
In certain cases, the user may request that the processing of his / her personal data be restricted.

Right to portability of personal data

In certain cases, the user has the right to have the personal data provided by them transferred to another controller.

Right to object to the use of personal data for direct marketing

A user can indicate at any time that Jane may no longer process their personal data for direct marketing purposes. In that case, the user will no longer receive commercial proposals.

How can you exercise these rights?

As a data subject, you can exercise the above rights by sending a request to privacy@jane.be. 

If we cannot uniquely identify you based on your application, we may ask you to send us a copy of the front side of the identity card (*) or to prove in some other way that you are the one who submitted the application.

A partner who processes personal data on behalf of Jane.

Processor agreement

A specific agreement between the processor and Jane whereby Jane determines and limits which data may be processed for which purposes.

DPO

Abbreviation for data protection officer or data protection officer in Dutch - person appointed by ASAP as contact person with regard to all matters related to the processing of personal data and the exercise of your rights in this regard.
